Martin MeyerParticipantRe: Tax issues, Either spouse may claim the medical expenses for the immediate family including dependents under the age of 18.
However, it may be advantageous for the lower income spouse to claim the medical expenses. This is because the amount of claimable medical expenses are reduced by 3% of the claimants Net Income ( to a maximum of $1,844), Which means that less net income = less reduction of claimable expenses. If the lower income spouse does not have enough Net Income to utilize all the medical expense credits then it might be better to have the higher income spouse claim the expenses. I hope this isn't going over the top but there's one more thing: you can shift the one year period to maximize the amount of medical expenses in the one year period. This is helpful to avoid being penalized twice by the 3% percent cutoff amount.
Hope that helps a bitMartin MeyerParticipantHi Micky,
here is a link to the Finance Ministry document that was refered to in the Globe and Mail.It appears to me that the eligibility will be based on the disability credit criteria.
