The Alberta Decision was the first court case in Canada addressing the rights of an autistic child to receive Lovaas Intensive Behavioral Treatment.  After the initial court case, there were several others.  This prompted the Alberta Government to create a provincial autism treatment program, although separate and apart from the provincial health care system.

Relevant Issues: Appellants requested that school provide financial assistance for Lovaas Treatment.

Status: Appellants successful. Director ordered to fund 90% of the cost.

Relevant Issues: The Appellant is appealing a decision re. refusal to provide financial assistance for Lovaas Treatment.

Status: The matter is referred back to the Child Welfare Appeal Panel.

Relevant Issues: The Appellant is again appealing a decision re. refusal to provide financial assistance for Lovaas Treatment.

Status: Services requested ought to be provided by Section 30 of the School Act.

Relevant Issues: Appellant requested funding for a home-based, intensive behavioural modification program.

Status: IBT should be funded by the school system, not Handicapped Children’s Services.

Relevant Issues: Appellant wished to enter an agreement with the Director of Child Welfare for the funding of specialized treatment services to her handicapped child under section 106 of the Act.

Status: Gov’t ordered to fully fund IBI irrespective of age.

Relevant Issues: Applicants seek interlocutory mandatory injunction to provide intensive speech therapy.

Status: Applicants do not meet the test for granting an interlocutory mandatory injunction.
