It needs a disputable examination whether the invalid’s insurance under article. 13 IVG has to cover the costs of the psychotherapy under Lovaas (Applied Behavioral Analysis [ABA]).

Zusammenfassend ist festzuhalten, dass die beim Versicherten durchgeführte, fachmedizinisch angeordnete und begleitete sowie wissenschaftlich überwachte Therapie nicht ohne weitere Abklärungen mit dem Argument fehlender Wissenschaftlichkeit abgelehnt werden kann.
It needs to be discussed that the specialised medically arranged and as well academically supervised therapy for the insured cannot be rejected with the argument of missing academic nature without further clarifications.
Status:
Die Beschwerde wird im Sinne der Erwägungen gutgeheissen und die Sache wird zur weiteren Sachverhaltsabklärung und zum neuen Entscheid an die Vorinstanz zurückgewiesen.
