Am 24.03.2003 beantragte der Kläger durch seine Mutter als gesetzliche Vertreterin die Übernahme der Kosten  im Wege der Eingliederungshilfe für eine Verhaltenstherapie, wie sie vom Institut für Autismusforschung Hans E. Kehrer in Form des Bremer Elterntrainings-programms angeboten werde, welches sich an der sogenannten Lovaas-Therapie orientiere. Ein dahingehend zuvor bei der Krankenkasse (DAK) gestellter Antrag wurde von dieser hinsichtlich der Kostenübernahme abgelehnt.

On the 24. 03. 2003 the plaintiff, through his mother as a legal representative, applied for the assumption of the costs for a behaviour therapy as a help to integration as it is offered by the Institute for Autism Research Hans E. Kehrer in the form of the Bremer parental training programme which orientates itself on the so-called Lovaas therapy. An application for the assumption of costs has been rejected by the health insurance scheme (DAK).

Status:

Die Beklagte wird unter Aufhebung ihres Bescheides vom 08.08.2003 und des Widerspruchsbescheides des Main-Kinzig-Kreise vom 08.06.2004verpflichtet, im Rahmen der Eingliederungshilfe die Kosten für die im Juli 2003 begonnene Maßnahme  „Bremer Elterntrainingsprogramm” (Haustraining, Video-Supervision, Supervision per Telefon) für den Kläger bis zum 31.08.2005 zu übernehmen.

The defendant is obliged under abolition of her order dated 08. 08. 2003 and the contradiction order of the county of Main Kinzig dated 08. 06. 2004, to cover the costs of the measures beginning in July, 2003 within the scope of the integration help „Bremer Elterntrainingsprogramm” (house training, video-supervision, supervision by phone) for the plaintiff until 31.08.2005.

Mit Schreiben vom 22. Juli 2003 beantragten die Eltern des Klägers bei der Stadt F. die Kostenüber-nahme für eine Verhaltenstherapie möglichst nach Lovaas, die in Amerika starten und ab Januar 2004 in F. fortgeführt werden sollte. Der Amtsarzt des Beklagten lehnte diese Therapie mit Stellungnahme vom 2. September 2003 im wesentlichen mit der Begründung ab, die Verhaltenstherapie nach Lovaas versuche unerwünschte Verhaltensweisen durch Bestrafungsformen abzubauen.

With letter dated 22nd of July, 2003 the parents of the plaintiff applied for the covering of the costs for a behavior therapy if possible under Lovaas which should start in America and be continued from January, 2004 in the city of F. The public health officer of the defendant rejected this therapy with statement dated 2nd of September, 2003 basically on the grounds the behavioral therapy to Lovaas tries to diminish undesirable behaviour patterns by punishment forms.

Status:

Der Kläger hat einen Anspruch auf Gewährung von Eingliederungshilfe gegen den Beklagten im Umfang von mehr als 10 Wochenstunden.

The plaintiff is entitled against to the grant of integration help against the defendant in the extent of more than 10 weekly hours.

Status:

Die Beklagte ist nicht verpflichtet, dem Kläger die begehrten Leistungen der Verhaltenstherapie einschließlich der Sozialpädagogik zu erbringen.

The defendant is not obliged to produce the requested achievements of the behaviour therapy including the social educationsocial eto the plaintiff.

Status:

Die Beschwerde des am 11. August 2001 geborenen Antragstellers gegen den Be schluss des Sozialgerichts (SG) Oldenburg vom 3. November 2006, mit dem das SG es abgelehnt hat, den Antragsgegner im Wege des den Erlasses einer einstweiligen Anordnung zu verpflichten, die Kosten einer ambulanten autismusspezifischen Therapie des Knospe-ABA-Insituts in Hespe zu übernehmen, hat Erfolg.

The complaint of the applicant born 11th of August, 2001 against the order of the social court (SG) Oldenburg dated 3rd of November, 2006 with which the SG has refused to oblige the application for an injunction to order the opponen to take over the costs of an ambulant therapy specific for autism of the Knospe-ABA-Insituts in Hespe, is successful.

Mit Aufnahme der Klägerin in den Schulkindergarten stellte der Beklagte die Leistungen ein. Einen Antrag auf Weitergewährung der Kostenübernahme der heilpädagogischen Behandlung neben dem Besuch des Schuldkindergartens lehnte der Beklagte ab.

The defendant rejected assumption of costs of the remedial-educational treatment beside the visit of the kindergarten.

Status:

Ob eine Maßahme der Eingliederungshilfe nach den Bestimmungen des Sozialgesetzbuches XII geeignet und erforderlich ist, setzt nach Ansicht des Sozialgerichts Freiburg, Urteil vom 18.02.2009 – S 12 SO 487/08, kein prognostisches Urteil über die Eignung nach dem Maßstab allgemein ärztlicher oder sonstiger fachlicher Erkenntnisse voraus. Allein entscheidend sei, ob die Maßnahme bezogen auf den Hilfebedarf wirke.

Whether a measure of the integration help is suitable according to the regulations of the social code XII and is necessary, assumes, in the opinion of the social court of Freiburg, judgment from the 18. 02. 2009 – S 12 SO 487/08, no prognostic judgment about the suitability under the standard of general medical or other technical knowledge. It is only vital whether the measure works.

Die Klägerin, gesetzlich vertreten von ihren Eltern, begehrt die Verurteilung des Beklagten zur Übernahme der Kosten einer Therapie zur Behandlung ihrer autistischen Störungen im Rahmen der Eingliederungshilfe für behinderte Menschen.

The plaintiff, legally represented by her parents, desires the conviction of the defendant for the assumption of the costs of a therapy to the treatment of her autistic disturbances within the scope of the integration help to handicapped people.

Status:

Die Klägerin hat gegen den Beklagten einen Anspruch auf Gewährung von Eingliederungshilfe für behinderte Menschen durch Übernahme der Kosten einer Therapie zur unterstützen und gestützten Kommunikation.

The plaintiff is entitled to granting of integration help against the defendant for handicapped people by assumption of the costs of a therapy for support and supported communication.

Antragsgegner hat die Übernahme der Kosten einer Therapie zur Behandlung ihrer autistischen Störungen im Rahmen der Eingliederungshilfe für behinderte Menschen abgelehnt.

The application opponent has rejected the assumption of costs of a therapy to the treatment of her autistic disturbances within the scope of the integration help for handicapped people.

Status:

Der Antragsgegner wird im Wege der einstweiligen Anordnungverpflichtet, dem Antragsteller vorläufig für die Zeit ab dem 08.12.2010 bis 30.06.2011, längstens jedoch bis zur Bestandskraft einer ablehnenden Entscheidung, die Kosten für eine autismusspezifische Förderung des Antragstellers durch das E-Insitut in der ABA/VB-Therpie zu gewähren.

The application opponent is obliged under an injunction to cover the costs for the time from 08.12.2010 until 30.06.2011, at the latest up to the legal validity of a negative decision, for a specific furtherance of the applicant for autism of the applicant by the E-Insitute under the ABA/VB-Therapy

Relevant Issues:

Zwischen den Beteiligten ist die Kostenübernahme für eine so genannte ABA-/VB-Therapie (applied behavior analysis/verbal behavior) des Klägers streitig.

The assumption of costs is disputable for the so called ABA-and VB therapy (applied behaviour analy-sis/verbally behav-ior) for the plaintiff.

Status:

Der Kläger hat nach dem Gesamtergebnis des Verfahrens Anspruch auf Gewährung von Eingliederungshilfe in Form der Übernahme der Kosten der ABA-Therapie des Instituts Knospe-ABA gemäß §§ 53, 54 Abs. 1 S. 1 Nr. 1 SGB XII i.V.m. § 12 Nr. 1 der VO nach § 60 SGB XII (Eingliederungshilfe-Verordnung – EinglHV).

The plaintiff is entitled to the granting of integration help in the form of the assumption of costs of the ABA therapy provided by the Knospe-ABA Institute according to §§53, 54 paragraphs 1 p. 1 No. 1 SGB XII and §12 No. 1 of the VO under §60 SGB XII (integration aid order – EinglHV).
