Below you will find a list of Australian Autism Court Cases.
In Australia, there are a few cases of alleged Discrimination – 2007 (2 cases) 2012, and 2013. All cases were brought to fight for appropriate Behavioral Treatment (ABA) which was denied to the child. The Australian Disability Discrimination Act and the Disability Standards for Education were difficult to apply in these cases. The 2012 case was settled, and the three others were dismissed.
Relevant Issues: Alleged discrimination against children with autism regarding access to ABA services.
Status: Complaints of plaintiffs are dismissed.
Relevant Issues: Alleged disability discrimination (Disability Disc. Act 1992) due to appropriate ABA treatment denied to the child. Purpose of application is to seek the approval of the court for an agreed upon settlement.
Status: Provisions in the Disability Discrimination Act difficult to apply. Judge orders the settlement to be approved.
